Kerala High Court Stays Proceedings Against Hindu Aikya Vedi Leader KP Sasikala In Alleged Provocative Speech Case

The Kerala High Court recently stayed all further proceedings against Hindu Aikya Vedi leader K.P. Sasikala Teacher in a 2022 case alleging that she had delivered a provocative speech in Malappuram intended to a cause riot.The alleged incident took place in Kunnumpuram in Malappuram on 31st August, 2022. Later, on September 20, a crime was registered by the Malappuram Police alleging commission of the offence under Section 153 of the Indian Penal Code [Wantonly giving provocation with intent to cause riot].In the FIR, it is stated that one Abdul Majeed submitted a complaint and based on the legal opinion given by an Assistant Public Prosecutor of the Judicial First Class Magistrate Court, the present crime was registered.Considering the facts of the case and the materials on record, Justice C.S. Dias granted an interim stay on further proceedings for a period of three months. It was observed:"On a consideration of the facts and the material on record...I am satisfied that the petitioner is entitled to an interim order. Hence, I stay all further proceedings in S.T. No.1677/2022 on the file of the Court of the Judicial First Class Magistrate, Malappuram, for a period of three months."Sasikala had made the headlines back in 2018 after she was arrested allegedly for sparking protests against women entering Sabarimala. In March 2022, the High Court had dropped all charges against Sasikala before Thodupuzha magistrate for purportedly triggering a dawn-to-dusk hartal in the State to protest the entry of women in Sabarimala temple in 2018. Later, in June the same year, another proceedings initiated in Kannur against Sasikala relating to violence in Sabarimala was quashed. Recently, a Magistrate Court in Cherthala had acquitted Rajmohan Unnithan, Congress MP representing Kasargod, in a defamation case filed by Sasikala.The case is next posted on March 10.The petition is moved by Advocate Sajithkumar V.Case No: Crl.MC 11389/2025Case Title: K.P.
