Proposed Eviction At Malayodamthuruthu: Kerala High Court Grants State 2 Weeks For Resolution, Restrains Munsiff Court From Passing Orders

The Kerala High Court on Thursday (June 4) further extended the time granted to the State to resolve the issue over proposed eviction of families residing in the contentious Malayodamthuruthu in Ernakulam district.
For context, on May 25, a period of 2 weeks was granted to the State, after it was submitted that efforts are being made to peacefully resolve the issues.
Today, Justice T.R. Ravi granted two more weeks till June 16. In the meanwhile, the high court asked the Munsiff Court not to pass in the execution proceedings pending before it.
When the matter came up for consideration, Advocate General Jaju Babu pointed to an order passed by the Munsiff Court, Perumbavoor on June 1 in the execution proceedings regarding eviction pending before it.
The Munsiff Court had issued directions to execute the decree and to file a report. As per the Munsiff Court order, the Amin was deputed to effect delivery and the Superintendent of Police, Aluva Rural was directed to provide adequate police assistance to the Amin, Advocate Commissioner and other court officials for execution of the decree and also, to ensure that no law and order situation arises during the course of execution.
The Munsiff Court had also ordered that if delivery is not completed on the scheduled date, the Amin and Advocate Commissioner are permitted to continue and complete the execution proceedings on the succeeding dates and file a report on or before 09/06/2026.
The Court observed:
"Apparently, on a misconception on the directions issued, an order appears to have been passed on 1/6/26 directing to effect delivery and report on 09/06/26. This Court had never passed such an order...The time granted by this Court is extended till 16/6/26. The trial court need not pass any orders in the meanwhile."
The issue dates back to 1984 when suits were instituted before the Munsiff Court, Perumbavoor by late Sankaran Nair seeking declaration of title of Pariyathukavu colony in Malayidomthuruthu. The Munsiff Court had decreed the suit in 2008 and litigations reached the Apex Court, which ultimately upheld the Munsiff's court findings.
Following these developments, execution proceedings were initiated but it could not be carried out, necessitating the descendants of Sankaran Nair to approach the High Court in another plea (OP(C) 3314/2025).
The Court, in March this year, disposed of the afore plea, and directed the Munsiff Court, Perumbavoor to issue necessary directions to the concerned police officers, to assist the Amin and the Advocate Commissioner to execute the order in letter and spirit by granting necessary protection.
However, the execution could not be carried out even then and the State approached the High Court present proceedings. According to reports, the government has assured the families living there that they would receive its support.
