Madhya Pradesh HC Dismisses Plea Seeking Licensing Procedure For Manufacturing And Selling Sharp-Edged Weapons

The Indore Bench of Madhya Pradesh High Court has dismissed a petition which sought direction to the Central Government to formulate a licensing procedure for manufacturing and selling sharp-edged weapons.The Court opined that Court cannot be used to compel the Government to formulate a policy for manufacturing sharp edged weapons which might only be used by 'unscrupulous' persons.Justice Subodh Abhyankar observed, “On due consideration, this Court is totally at loss to understand as to why the petitioner wants to legalize the manufacturing and selling of sharp edged weapons, and licensing procedure for sharp edged weapons. It is also found that earlier a Public Interest Litigation bearing Writ Petition No.5566/2022 was filed by the petitioner citing personal interest but, the same has been dismissed by the Division Bench of this Court vide order dated 10.05.2025, and allowed to avail the alternative remedy.”A petition was filed under Article 226 of the Constitution seeking direction to the respondents to formulate a licensing procedure for manufacturing and selling sharp-edged weapons.On perusal of the reliefs prayed for, the Court noted that the petitioner was not aggrieved by any action or inaction of the respondents which may have affected his legal or fundamental rights.Further, on perusal of the writ petition, the Court noted that the petitioner has nowhere mentioned that his legal or fundamental rights have been affected. The petitioner through the petition just wants the respondents to formulate a licensing procedure for manufacturing and selling of sharp edged weapons.The Court expressed concern as to why the petitioner wanted to legalize the manufacturing and selling of sharp edged weapons, and licensing procedure for sharp edged weapons. “In such circumstances, this Court is of the considered opinion that the Forum of this Court cannot be used to compel the State Government to form policy for manufacturing sharp edged weapons, which may only be used by the unscrupulous persons.”, the Court said.The petition was hence, dismissed.Case Title: Subhash Singh Tomar Versus Union Of India Through Its Secretary And Others, Writ Petition No. 12562 Of 2025Citation: 2025 LiveLaw (MP) 91Click Here To Read/Download Order
