Madhya Pradesh High Court Stays Attempt To Murder Trial Against BJP Leader Akshay Kantilal Bam And His Father Till May 02

The Indore Bench of Madhya Pradesh High Court has stayed the Trial proceedings against BJP Leader Akshay Kantilal Bam and his father in attempt to murder case under Section 307 of the Indian Penal Code, 1860.A single judge bench of Justice Sanjeev S. Kalgaonkar observed, “In peculiar facts and circumstances of the case, it is directed that further proceedings of the trial shall remain stayed till the next date of hearing only. Meanwhile, learned counsel for the State is directed to requisition and submit the case diary and relevant documents.”The development comes in a revision petition filed by the duo challenging trial court order refusing to discharge them. As per the prosecution, the petitioners along with 7-8 persons entered the land of Respondent No. 2-Yunus Patel and objected to the servants harvesting the crop. On receiving the information, Respondent No. 2 and one other person went to the field. When they reached there, Kantilal Bam is stated to have exhorted the co-accused to fire at them. The co-accused fired a shot, however, it did not strike. Thereafter, Respondent No. 2 lodged FIR against the petitioners.During the hearing on April 4, the counsel for the petitioners submitted that the trial is pending since 2014. The complainant had filed an application before the Judicial Magistrate First Class (JMFC), Indore which was allowed and the case was committed for trial to the Court of Sessions in relation to the offence. It was further contended that despite the pendency of trial before the JMFC for 17 long years, no application for cognizance of offence was ever filed. The application was only filed when Akshay declared his candidature for elections. The matter was then committed to the Court of Session and the charges were framed. The case has been fixed for recording of evidence on April, 30. Thus, the petitioners raised objection to the process as well as framing of charge.On the contrary, the counsel for State submitted that JMFC committed the case to the Court of Sessions on the basis of material on record and the Sessions Judge framed charges as the offence alleged was made out against the petitioners.The Court however directed that further proceedings be stayed till the next date of hearing, i.e. May 02.Case Title: Akshay Kantilal Bam And Others Vs The State Of Madhya Pradesh And Others, CRR No. 1483 of 2025Click Here To Read/Download Order
