Burden Of Cases Over Courts Can't Be Ignored: MP High Court Imposes ₹50K Cost On Nursing College For Filing Frivolous Petition

While dismissing a review petition filed by a Nursing College seeking grant of recognition, the Madhya Pradesh High Court imposed a cost of Rs. 50,000 on the petitioner-college for wasting court's time by filing frivolous petitions and applications.The court also remarked that the petition has been drafted very carelessly and without any sensible approach.The division bench of Justice Sanjay Dwivedi and Justice Achal Kumar Paliwal observed, “As informed by learned counsel for the respondents, the petitioner-college has already filed 5-6 petitions for the same issue. Thus, it is clear that the petitioner, without any foundation, is wasting Court's time by filing frivolous petitions and applications. Though, according to the petitioner, the issue involved in the case might have its own importance, but simultaneously the fact in respect of burden of cases over the Courts cannot be ignored and despite that frivolous applications are being filed time and again.”Earlier, the court had rejected the petition filed by the petitioner-college on the ground of delay when they were seeking recognition for the Session 2022-23. Later, the petitioner-college sought recognition for the session 2024-25. However, the court also dismissed the said petition stating, “Once the recognition for the session 2022-23 is not there with the petitioner-college, it cannot be granted for the session 2024-25 as there is no continuity, although the petition is disposed of directing petitioner to make an application for fresh recognition for the session 2025-26 because for the session 2024-25, the respondents are not granting recognition to any new college and if the application is made before the respondents for granting recognition for the session 2025-26, their application shall be considered and treated to be a fresh application for the session 2025-26…”The present review petition was filed mainly seeking quashing of report passed by the Committee constituted by the Court. “We are surprised as to how this review petition can be filed seeking quashing of report dated 07.11.2024 (Report stating deficiencies in petitioner-college) especially when the petition got already disposed of taking note of the report of Committee dated 07.11.2024.”, the Court said.Thus, the court dismissed the petition imposing a cost of Rs. 50,000 be deposited by the petitioner college with the Madhya Pradesh State Legal Services Authority within a period of 30 days. “…a receipt whereof be also submitted before the Registry of this Court, failing which, recovery of said amount be made from the petitioner-college as per the provisions of Madhya Pradesh Land Revenue Code, 1959.”, the Court said.Case Title: K.L.
