Plea In Madras High Court Seeks CBI Probe Into Sexual Assault Of Minor Girls At Fake NCC Camp In Krishnagiri

A petition has been filed in the Madras High Court seeking a CBI probe into sexual assault of minor girl students at a fake NCC camp in Krishnagiri District in Tamil Nadu. The matter will be heard by a bench of Acting Chief Justice D Krishnakumar and Justice PB Balaji. The alleged incident came to light after a girl was admitted to the Krishnagiri Government Hospital following pelvic pain. The girl informed that she was raped by the main accused Sivaraman, who claimed to be a NCC trainer at the camp. Later, the NCC clarified that the persons involved in the incident were not connected with the NCC nor any NCC camp was conducted in the district. Sivaraman died by suicide on 23rd August while under police custody. The petitioner, Advocate AP Suryaprakasam, in his petition, submitted that the entire investigation being carried out by the state police was a farce and eye wash which was evident from the death of the main accused under police custody in mysterious circumstances. Suryaprakasam submitted that the fundamental right of the girl students and their parents to live with dignity was at stake and the State was expected to conduct a proper investigation to find out all the culprits and bring them before the law and ensure proper punishment for the perpetrators who have committed the serious physical violation of the body of innocent girl children. however, he added that the death of the main accused raises a suspicion that there was an attempt to close the investigation by shifting the blame on the deceased and filing a final report thus giving quietus to the issue. Suryaprakasam added that if the attempt of the state police is allowed to succeed without finding the exact nature of the sexual atrocities committed and if the state fails to establish the sexual offenses against children, they would not be entitled to any monetary benefits under the victim compensation scheme or other psychological advice from experts which will help them have proper rehabilitation under Article 21 of the Constitution. Suryaprakasam thus pointed out that if the state police continued the investigation, justice would not be rendered to girl students who were subjected to sexual brutality by the main accused. Thus, he submitted that it was just and proper that the investigation be transferred to the CBI. As an interim measure, Suryaprakasam also urged the court to provide all physical, mental and monetary relief as per Section 19(6) of the Protection of Children from Sexual Offences Act and the Juvenile Justice Act to the affected children without waiting for the final outcome of the case.
