The Meghalaya High Court has rejected the third bail applications filed by two Bangladeshi nationals accused in a case involving alleged offences under the Bharatiya Nyaya Sanhita, 2023, the Arms Act, 1959, the Foreigners Act, 1946, and the Explosive Substances Act, 1908, noting that only one prosecution witness remained to be examined.
Justice W. Diengdoh remarked that: “This Court is also made to understand that out of ten prosecution witnesses, only one witness remains to be examined. As such, in the interest of justice, this Court finds no reason to allow the prayer made in this petition, but would request the Trial Court to proceed with the trial expeditiously and to conclude the same at the earliest.”
Background
The applicants, Saem Hussain and Mafuzur Rahman, both Bangladeshi nationals, were facing trial in connection with Nonghyllam Police Station Case No. 09 of 2025, registered as Sessions Case No. 11 of 2025.
They filed their third bail applications under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, contending that they had been falsely implicated and that the prosecution evidence did not establish a prima facie case against them.
They also offered to furnish sufficient sureties to ensure their presence during the trial. The State opposed bail, citing the seriousness of the alleged offences and the risk of the applicants absconding.
The Meghalaya High Court observed that only one of the ten prosecution witnesses remained to be examined. Considering the stage of the trial, the Court found no reason to grant bail to the applicants and held that an expeditious conclusion of the proceedings would sufficiently address their situation.
Accordingly, it dismissed both bail applications as devoid of merit and requested the trial court to conclude the trial at the earliest.
Date of Decision: 25.09.2026
