    The Registry of Orissa High Court on Wednesday notified that in motor accident claim cases, if the claimant(s) have filed separate claim petition(s) in the territorial jurisdiction of different High Courts, the first claim petition filed by them shall be maintained by the said Claims Tribunal and the subsequent claim petition(s) shall stand transferred to the Tribunal where the first claim petition was filed and pending.

    It was also clarified that the claimant(s) are not required to approach the Supreme Court seeking transfer of other claim petition(s) filed in the territorial jurisdiction of different High Courts pursuant to the decision of the Apex Court dated 15.12.2022 in Gohar Mohammed v. Uttar Pradesh State Road Transport Corporation & Ors.

    In the aforesaid case, the Supreme Court had taken note of the prevalent practice to file transfer petitions before it to transfer claims cases made before multiple tribunals of different High Court jurisdictions.

    While discouraging such practice, it had asked the Registries of the High Courts to pass appropriate directions so that all the claim cases can be transferred to the tribunal where the first claim case was filed.
