'Sorry State Of Affairs': Patna High Court Says Citizens Forced To Approach Court For Aadhaar Correction, Directs UIDAI To Act

The Patna High Court has expressed concern over the increasing number of petitions seeking correction of date of birth in Aadhaar records, observing that citizens are being unnecessarily forced to approach the Court despite fulfilling statutory requirements.
A Single Judge Bench of Justice Ajit Kumar was hearing a writ petition filed by a petitioner seeking correction of his date of birth in his Aadhaar card from 24.07.2008 to 24.07.2007 in accordance with his matriculation certificate.
The petitioner submitted that although he had made an application before the authorities for correction of his date of birth, the same had not been considered for unexplained reasons.
On the other hand, counsel for the Union of India submitted that the petitioner may appear before the Director, UIDAI Regional Office, Patna, along with a representation, and the necessary correction would be carried out upon verification of the required statutory documents.
Taking note of the issue, the Court observed:
“It is a very sorry state of affairs, which this Court has witnessed today, that in so many cases, for correction of date of birth, the applicants are forced to knock the doors of this Court. It is expected that the Director, UIDAI Regional Office, Patna, would issue appropriate instruction to the persons who are dealing with such issues, so that this Court is unnecessary not burdened with such petitions where, for correction of date of birth, the statutory requirement of documents are already being fulfilled and the persons who are at the helm of affairs are to carry out the formalities, and accordingly, the necessary corrections are required to be made in the Aadhar database, which somewhere is not being addressed properly”
The Court further emphasised that where statutory documents are already available, the concerned authorities ought to carry out necessary corrections without compelling individuals to seek judicial intervention.
Accordingly, considering the nature of relief sought, the Court directed the petitioner to approach the Director, UIDAI Regional Office, Patna, within one week. It further observed that upon such appearance, the authorities are expected to carry out the necessary corrections after verifying the relevant documents.
