High Court Seeks List Of NDPS Accused In Haryana Not Arrested For More Than 6 Months

The Punjab and Haryana High Court has directed the Director General of Police (DGP) of Haryana to file a list containing names of those accused under the Narcotic Drugs and Psychotropic Substances Act 1985, who have not been arrested for last more than six months.Justice N.S. Shekhawat also asked about steps taken by the police to arrest such accused and whether any action has been taken against the Investigating Officer (IO) in such cases, if some negligence is found on the part of the IO.The affidavit which is required to be filed by the DGP, should include the following:Whether any steps have been taken by the police to declare such accused as proclaimed offenders/proclaimed persons under the provisions of Section 84 of B.N.S.SWhether any application has been moved to the Court for attachment of the moveable and immovable properties of such absonders.The Court was hearing plea seeking directions to State to probe NDPS cases in fair and impartial manner or to handover the investigation to an independent investigating agency.During the hearing, the Court found that petitioner was involved in 12 criminal cases under NDPS Act, Arms Act and IPC."It is apparent that the present petitioner is a habitual offender and is a notorious drugs smuggler. Even, the FIR was registered on 06.02.2025 and even after a period of six months, the police has failed to take action against such a drugs smuggler, which clearly proves that the officials of local police are hand in glove with the accused in the present case," the judge noted.Justice Shekhawat highlighted that in various cases, the Court has also noticed that there is no supervision of investigation of cases, which were registered under the provisions of NDPS Act in various Districts of Haryana.Consequently, the Court directed DGP, Haryana to file a list of all the cases registered against the accused under the provisions of NDPS Act in all the police stations of Haryana, where, the accused have not been arrested for the last more than six months.
