    The Punjab & Haryana High Court has directed the Chandigarh Police to protect, for a week, a family who is allegedly receiving threats from BJP MP Kirron Kher.

    Justice Anoop Chitkara said, “Thus, in the facts and circumstances peculiar to this case, it shall be appropriate that the concerned Superintendent of Police and the concerned SHO provide appropriate protection to the petitioner for one week from today. As such, respondent no.1 (UT of Chandigarh) is directed to ensure protection of petitioner and his family and direct the concerned Superintendent of Police/SHO to provide them protection for a period of one week.”

    Senior advocate Anmol Rattan Siddhu appearing on behalf of the petitioner Chaittnya Aggarwal submitted that his wife Ruchika Aggarwal and his two minor daughters are apprehending threats to their life and liberty from BJP MP Kirron Kher.

    The petitioner alleged that he had been investing money for Kher in the market, however, because the market was volatile he was unable to pay some returns on time.

    Furthermore, the petitioner submitted in the plea that Kher was threatening to kill him and had also physically assaulted, demanding him to pay double the amount. However, he has returned the dues, the petitioner submits.

    Considering the allegations and without going into the merits of the case, the Court opined, “if this Court does not give them protection for the time being, that might amount to not exercising the constitutional jurisdiction.”

    While issuing directions for protection, the Court imposed certain restrictions so that the security is not “flaunted or misutilized.”

    This protection is subject to the stringent condition that from the time such protection is given, the petitioner and his wife shall not go outside the boundaries of the place of residence, except for medical necessities, to buy household necessities, and for bereavements in the families of the close relatives or close friends, the Court added.

    It further clarified that if the petitioner or his wife violates any of the conditions even for once, then the protection order “shall stand recalled automatically without any reference to this Court and it shall be permissible for the deployed police personnel to leave the premises of the petitioner after informing the concerned SHO/Superintendent of Police through electronic mode or sending a message.”

    While disposing of the plea, the Court said, “This order shall eclipse on Dec 19, 2023 at 2 PM.”
