Punjab & Haryana High Court Directs Home Developer To Provide Land To PSPCL For Providing Infrastructure For Electricity In Society

The Punjab and Haryana High Court has directed a home developer to provide two acres of land to the Punjab State Power Corporation Limited (PSPCL) for the installation of essential electricity infrastructure in a residential society. The directions comes in response to long-standing grievances raised by residents over the lack of basic amenities, including electricity connections, due to the developer's non-compliance with regulatory conditions. Justice Sureshwar Thakur and Justice Vikas Suri said, "However, only that fraction or that part of the supra land as is direly required for the additional electricity purveying infrastructure being installed, thus, be forthwith transferred, but free of cost in favour the PSPCL. Emphatically, to the considered view of this Court, two acres land may be far in excess, to the relevant requirement." The petitions were filed by various residents and the Residents' Social Welfare Association, seeking the High Court's intervention to compel the State to take action against a home developer who has failed to complete a project for over 15 years, despite legal orders and approved conditions. It was alleged that funds were misused, the project lacked basic amenities, and the developer exerted undue influence over officials. The prayer included taking over of the project by the State, cancellation of licenses and approvals, completion of the development work, and action on a pending public nuisance complaint.After hearing the submissions, the Court examined that the compensation related to a developer and ordered the conditional release of funds as per awards passed in 2018 2023. The Court also directed the external development works in the colony to be completed using funds from the sale of mortgaged plots, to be overseen by the District Collector. However, previous interim orders prevented auctioning of the plots, and the court decided to vacate these orders to facilitate the completion of works.Additionally, issues regarding the installation of electricity infrastructure were raised, with PSPCL noting that the developer had failed to comply with the conditions required for providing electricity connections. The Court instructed the developer to provide land for the installation of the necessary infrastructure to facilitate these connections.
