High Court Dismisses Plea Seeking CBI Probe Into Alleged Fake Encounter By Punjab Police

The Punjab and Haryana High Court has dismissed a plea as withdrawn by the petitioner, seeking a CBI probe into an alleged fake encounter carried out by the Punjab Police.The police party was allegedly the same as the one accused of assaulting Col. Pushpinder Singh Bath and his son.Justice Sanjay Vashisth during the hearing orally observed that the petitioner has no relation with the deceased and held that he has no locus standi to file the present plea. The Court accordingly suggested the petitioner to either withdraw the petition or the Court would proceed to pass an order.Gurtej Singh Dhillon, filed the petition under Section 528 of BNSS, for marking time bound enquiry under the Supervision of this Court to the CBI into the killing of a young person namely Jaspreet Singh, aged 22 years in an apparently false encounter as described by the police in FIR under Sections 109, 132, 221, 281, 125(b) of BNS and Section 25 of Arms Act, registered at Police Station Sadar Nabha, District Patiala.Dhillon stated to be brother-in-law of the Colonel who was allegedly recently brutally assaulted by the Punjab Police.Chanchal K. Singla, Addl. A.G., Punjab, appearing on behalf of the State, submitted that the petitioner neither falls under the definition of “victim” as per Section 2(y) of BNSS, 2023, nor has any locus standi to file the instant petition before this Court to achieve his personal goals.Singla further pointed out that actual victim in the incident, if any, are parents of the deceased, who have already filed a similar petition which is now fixed for hearing on September, 17.Faced with the situation, counsel for the petitioner prayed for withdrawal of the present petition.Consequently, the petition was dismissed as withdrawn.Mr. Navkiran Singh, Advocate Ms. Harpreet Kaur, Advocate for the petitioner.Mr. Chanchal K.
