    The Punjab & Haryana High Court today issued notice to the states of Punjab and Haryana on a habeas corpus petition which alleged that a man was illegally detained by the Haryana Police during the farmers' protest on February 21.

    The plea was filed by the father of the alleged detenue, who was stated to be a resident of Punjab and was part of "peaceful farmers agitation". It was alleged that the detenue was stopped at Khanauri Border due to barricades put by the Haryana Government.

    It has been alleged that during the protest, the Haryana Police, after entering the "territory of Punjab", attacked the alleged detenue . The petitioner stated that he got information that the detenue was taken to PGI Hospital Rohtak as he sustained severe injuries. Although 48 hours have gone by, the detenue has not been produced before any judicial authority nor given any proper medical treatment, the petitioner said.

    The petitioner also sought to allow the alleged detenue to be shifted to PGI Chandigarh or Rajindra Hospital Patiala to enable his family to properly attend to his needs.

    Justice Harkesh Manuja while issuing notice to the respondents, also directed the registry to appoint a warrant officer to accompany the petitioner to PGI Rohtak or any other place pointed out by the petitioner to find out the alleged detenue. In case the alleged detenue is found to be in illegal detention, the Court directed the warrant officer to ensure his release. The Superintendent of Police, Rohtak, was asked to provide assistance to the warrant officer.

    The Court also sought a report from PGI Rohtak regarding the latest status of the medical condition of the detenue and injuries, if any, upon him.

    The matter is listed for February 26, for further consideration.
