    Madhya Pradesh High Court has recently directed the Station House Officer of Tilaknagar Police Station to take appropriate action in the complaint made by Congress Spokesperson Aminul Khan Suri against BJP Minister Kailash Vijayvargiya. The complaint pertains to Vijayvargiya allegedly sharing a false video on X (formerly known as Twitter) to incite the communal riots that erupted in Khargone during the Ram Navami Procession in April 2022.

    The single judge bench of Justice Pranay Verma has instructed the police that appropriate action should be taken after considering Suri's complaint within a period of 90 days. The Police is also required to duly inform the complainant about the outcome of the complaint after scrutiny.

    “…The petitioner is directed to furnish within a period of 7 days from today proof before the Station House Officer Police Station Tilak Nagar, District Indore, as regards the filing of the complaint by him on 16/4/2022”, the bench sitting at Indore further added as a precondition for consideration of the complaint.

    Relying on Rajendra Singh Pawar & Ors. v. State of M.P. & Ors . (2021), the court iterated the necessary steps ought to be taken by the concerned police officer in the process of examining the complaint and undertaking the preliminary inquiry. The police officers are required to process the complaints received by them within 15 days. If the officers are unable to do so, they are expected to take action on the complaint within a maximum period of 42 days after receiving the complaint, the court reproduced the relevant excerpt from Rajendra Singh Pawar.

    “…If complaints remain pending for more than 42 days then Superintendent of Police shall initiate Departmental Enquiry against delinquent Police Officer”, the single judge bench of Justice Vishal Dhagat had noted back in 2021.

    After citing the above reasons, the court disposed of the writ petition.

    Advocate Jayesh Gurnani appeared for the petitioner. Govt. Advocate Bhuwan Deshmukh represented the state.
