The Rajasthan High Court has stayed the termination of a government employee whose services were terminated over allegations that he had suppressed and concealed information relating to his criminal conviction, which had already been stayed by a coordinate bench of the Court.
The bench of Justice Anuroop Singhi took note of the earlier order staying the petitioner's conviction in a criminal case. The coordinate bench had observed that allowing the conviction to operate could cause irreparable loss to the petitioner, a government servant, by adversely affecting his career in service.
The petitioner had challenged the order dated July 30, 2026, terminating his services on allegations of suppression and concealment. His counsel submitted that while filling up the relevant form, he had been asked whether he was an “ex-criminal”, to which he had answered in the negative. According to the petitioner, this response was factually correct.
It was further argued that, in view of the stay of his conviction by the coordinate bench, the declaration and affidavit submitted by him were made under a bona fide belief. The petitioner also contended that he had not been given prior notice before the termination order was passed, in violation of the principles of natural justice.
Taking note of these submissions, the Court issued notice to the respondents and stayed the effect and operation of the termination order until further orders.
The matter will next be heard on September 29, 2026.
