The Telangana High Court has held that mandatory submission of application along with documents for MBBS/BDS course only through online mode, by Kaloji Narayana Rao University of Health Science (KNRUHS) is not illegal or discriminatory.

Equally the submission that the petitioner cannot operate computer, is misconceived, as she has participated in the NEET UG 2023 examinations online and secure rank,” said the court.

The division bench of Chief Justice Alok Aradhe and Justice T. Vinod Kumar was hearing a plea filed by a medicine aspirant Golluri Sri Vishnavi Devi, challenging the schedule of admission released by Kaloji Narayana Rao University of Health Science (KNRUHS) for MBBS/BDS Course on the ground that it was not duly notified and that submission process did not provide for submission and verification through physical mode.

The petitioner contended that due to the schedule of examination not being duly notified, the petitioner, who is a resident of Malkajgiri, a village, could not submit her application within the prescribed time. She further contended that due to her lack of resources, she was not in a position to submit the application form through online mode.

The counsel on behalf of the petitioner Advocate S. Suman contended that petitioner ‘recently’ got to know about the schedule and hence has filed the present petition seeking the interference of the Court. She further prayed that the Court may understand the shortcomings of the petitioner and direct the University to accept her application through physical mode.

The counsel on behalf of the University Advocate A. Prabhakar Rao contended that the schedule for the course was duly notified, on the basis of which, many students applied, and candidates have been selected for the MMBS/BDS Course.

The submission made on behalf of the petitioner that no publicity was given to the schedule of Admission for MBBS/BDS cannot be accepted as several candidates (twenty two thousand) have responded to the admissions, by submitting applications,” the bench observed.

Advocate Rao further contended that the rank secured by the petitioner in NEET UG 2023 is after a lakh, and even if she was permitted to submit her application, she would not be able to secure a seat.

“The petitioner was required to submit the application along with documents online, in order to enable her to participate in the admission process. No explanation has been given as to why the petitioner has filed the writ petition after a delay of 13 days. Every single days delay in such a dispute counts. Therefore it in unimaginable that the petitioner who has passed the class 12 examination and resides in a district headquarter is not aware about the process of admission.
