No Legal Basis To Deny Woman Jailor Promotion As Recruitment Rules Make No Gender Distinction: Tripura High Court

The Tripura High Court has held that, in the absence of any provision in the Recruitment Rules prescribing gender-based restrictions, a Female Jailor cannot be denied consideration for promotion to the post of Deputy Superintendent (Home) Jail solely on the ground of her gender. The Court observed that the applicable Recruitment Rules do not distinguish between male and female Jailors for promotional purposes and ruled that there was "no legal scope" to deprive the petitioner of promotion on the basis of gender discrimination.Justice Biswajit Palit remarked that: "In the recruitment rules relied upon by the petitioner, it appears that there is no gender discrimination in the said recruitment rules regarding promotion of any Female Jailor to the post of Deputy Superintendent. So, in absence of any specific rule there is no legal scope to deprive the petitioner to be promoted to the post of Deputy Superintendent (Home) Jail on the ground of gender discrimination."Background:The petitioner joined the Tripura Jail Department as a Female Sub-Jailor in 1997 through the Tripura Public Service Commission. Although she became eligible for promotion to the post of Female Jailor after completing ten years of service, she was promoted only in 2018 pursuant to directions issued by the High Court in an earlier writ petition.After serving as Jailor for five years, she claimed eligibility for promotion to the post of Deputy Superintendent under the applicable Recruitment Rules. When the authorities failed to consider her claim, she approached the High Court in another writ petition, wherein the Court directed the authorities to consider her case. However, instead of granting consideration, the Inspector General of Prisons issued a communication dated May 1, 2025 declaring that she was not eligible for promotion.Aggrieved, the petitioner filed the present writ petition contending that the denial was based solely on her gender despite there being no such restriction under the Recruitment Rules. The Court found that the petitioner had an unblemished service record and had been discharging her duties as a Jailor satisfactorily since her promotion in 2018. While reiterating that promotion cannot be claimed as an absolute right, the Court held that an eligible employee is entitled to fair consideration for promotion based on merit and service record. The respondents had not placed any adverse material against the petitioner to justify denial of such consideration.The Court further held that the applicable Recruitment Rules did not create any distinction between male and female Jailors for promotion to the post of Deputy Superintendent. Therefore, in the absence of any statutory provision prescribing such a restriction, the authorities could not deny the petitioner promotion solely on the basis of her gender.The Court also noted that the State failed to justify the communication rejecting the petitioner's claim and had not complied with an earlier order directing consideration of her case. It therefore concluded that the impugned communication was contrary to the Recruitment Rules and could not be sustained.Case Name: Smti.Bela Dutta v.
