NCLT Bar Association Writes To Ministry Of Corporate Affairs Over Infrastructure Crisis Causing Standstill At NCLT Delhi

On 04.09.2025, the National Company Law Tribunal Bar association has made an urgent representation to the Secretary, Ministry of Corporate Affairs, expressing concern regarding the persistent infrastructure challenges faced by the National Company Law Tribunal, New Delhi Bench. On 03.09.2025, a public notice was issued by the NCLT informing all stakeholders that the 8th floor of the Block which has the Court Nos. IV, V and VI has become non-operational due to severe roof seepage. The Bar Association stated: “The closure of the 8th floor has exacerbated the situation, bringing the functioning of the NCLT to a near standstill. All courts under the New Delhi Bench are now operating on a half-day basis, resulting in a severe disruption of judicial proceedings. This has led to a complete obstruction in the administration of justice, effectively denying citizens access to legal remedies as guaranteed under Article 39A of the Constitution of India.” It also represented that even prior to the recent problem that has occurred, the space from where the NCLT currently operated i.e., the 6th, 7th, and 8th floors of Block 3, CGO Complex, Lodhi Road is inadequate to meet the Tribunal's operational requirements. The Court No. VI functions temporarily as a half-day court from Court Room No. V. Further, the Bar submitted that it has consistently been trying to request the Ministry and other concerned authorities to relocate the NCLT New Delhi Benches to a more suitable and spacious facility. A Writ Petition (C) (PIL) No. 6037 of 2018 filed by the Bar Association is still pending before the Delhi High Court. Even though the Delhi High Court had allotted the first floor of the building for use of NCLT pursuant to directions of the Delhi High Court, however due to construction and renovation work being halted on the first floor it has yet not been handed over to the Tribunal yet. Therefore, the Bar Association requested the ministry to take immediate steps to restore normal functioning of the Tribunal.
