    Essential Qualification and Experience

    · Candidate should have relevant qualification as per the roles & responsibilities along with 8-10 years of experience.

    · Desired: Bachelor of General Law Degree.

    Roles & Responsibilities

    · Litigation: (a) Handling litigations for the Company in various Courts/Forums including Labour Courts, Industrial Courts, Small cause courts, Magistrate Court, District and Session Courts, High Courts etc PAN India, (b) Handling Arbitration proceedings and proceedings before the High Court arising out of such Arbitrations, briefing and assisting the external Counsels in the ongoing Arbitration proceedings, (c) Drafting statement of claim, interim applications, statement of defense, affidavit in reply, evidence affidavit, rejoinder, surrejoinder, counter claims, (d) Drafting reply to legal notices, regulatory notices, active/inactive employees, third party association or Labour union representations etc., (e) Assessment and evaluation of risk arising out of pending litigation cases, (f) General advisory to internal / external stakeholders on ongoing litigations, litigations strategy, evidence collection guidance and support to stakeholders, briefing to witnesses, and (g) Legal Research on issues / challenges faced.

    · Employment Matters: Handling Labour/Employment Litigations across India raised under Industrial Disputes Act and other labour laws, succession matters, family dispute matters.

    · Advise to internal stakeholders on Policy matters, IR/ER issues, compliance matters related Contract Labour (Regulation & Abolition) Act, Social Security and other benefits administration, Court notices, witness summons etc., (b) Discipline Management: Drafting / review of show cause notice, charge-sheet, Termination / Discharge / Dismissal Order under Industrial Employment Standing Order or Service Rules of the Company and other miscellaneous disciplinary documents, (c) Handling the litigations or disputes raised under Industrial Disputes Act or Unfair Labour Practices, and (d) Global mobility / deployment documents review and legal support for mobility challenges, cross border employment litigations etc.

    · Vendor Contracts: Responsible for independent handling, drafting and reviewing Master Service Agreement, Statement of Work, Service Level Agreement, MOU and other vendor contract agreements (Supply of Goods and Services Agreement, Facilities Management Agreement, Attornment Deeds, Bank Guarantees, Employment, and (b) Contracts, Subscription Agreement, Event Sponsorship Agreement, Various Service Agreements, Consultancy Services Agreement, Licensing Agreement, Corporate Tie Up Agreements, CSR Agreements, Lease Financing Agreement, Master Rate Contracts, Notice of Termination, etc.)

    · Management Reporting / Audits: (a) Preparing Litigation Reports for senior management and external auditors, (b) Handling Audit queries regarding litigations, and (d) Obtaining independent evaluation from external Counsels on all pending Litigations.

    · Data Privacy Laws: (a) Basic Knowledge on Data Privacy and Data Protection Laws prevailing globally, (b) Reviewing Data Processing Agreements or Data Transfer Agreements, (c) Sound understanding of the compliance obligations of Controller and Processor, Standard, and (d) Contractual Clauses obligations, modules, applicability and enforcement.
