The US Court of Appeals for the Fourth Circuit has ruled that West Virginia's ban on transgender girls participating in girls' sports teams infringes upon the rights of transgender students under Title IX. The ruling came following suit filed by a 13-year-old transgender girl named Becky Pepper-Jackson, challenging the constitutionality of the 'Save Women's Sports Act'. They argued that the Act aimed to preserve fairness and safety in women's sports by preventing individuals assigned male at birth from competing on girls' teams. The defendants contended that allowing transgender girls to participate in girls' sports could result in unfair advantages due to physiological differences, particularly in cases where individuals had not undergone puberty-blocking medication or hormone therapy. Additionally, they argued that the Act did not violate Title IX and was within the State's authority to regulate sports teams based on biological sex. Title IX applies to all educational institutions, from elementary schools to colleges and universities, as well as to other entities that receive federal funding, such as vocational schools and libraries. Under Title IX, educational institutions are prohibited from discriminating based on sex in any program or activity, including athletics, and are required to provide equal opportunities and resources to both male and female students. This includes ensuring equal access to sports teams, facilities, equipment, coaching, and scholarships. Additionally, Title IX mandates that institutions take prompt and effective action to address and remedy instances of sexual harassment and sexual violence.
