The Madhya Pradesh High Court has rejected the appeal of a man demanding a probe through the Central Bureau of Investigation or any other specialist agency into the death of his son whose body was found at Saraswati Ghat on banks of river Narmada.

The ground taken by the petitioner to challenge the single judge bench order was based upon the time of death given by the doctor conducting postmortem.

The boy went missing on 10.11.2015, while his body was found on 19.11.2015, in a decomposed state.

In the postmortem report, the doctor mentioned the time passed since death was about 2 days and the approximate date of death was 18.11.2015.

Thus, the appellant became suspicious over the time of death of his son and sought probe through the independent agency.

The doctor opined the cause of death could not be ascertained, whereas vicera and tibia bone were preserved for analysis. On chemical examination, nothing objectionable was found in the report of 26.02.16.

A bench of Chief Justice Hemant Gupta and Justice Vijay Kumar Shukla said: “We find that two days seems to be apparent mistake, as the condition of the body may not deteriorate to such an extent within two days.”

“In fact, it appears to be 2 weeks, which was inadvertently or by oversight, mentioned as 2 days,” the bench said.

The court upheld the single judge bench’s order.
