2011 Shanti Bhushan CD Case: Delhi Court Directs Further Investigation On Nine Points

A Delhi Court has recently directed the police to continue its probe for the second time into the 2011 case pertaining to a controversial CD involving conversation between former Law Minister Shanti Bhushan and politicians Mulayam Singh and Amar Singh. Chief Metropolitan Magistrate Pankaj Sharma, in the order dated 10th December 2020, ordered thus: "After careful perusal of the record, it appears that the investigation has not been carried out in terms of the order dated 25.01.2012 wherein police was directed to investigate the matter on nine points. Let IO to file a further report on 28.01.2021." After going through the contents of the eport submitted by Delhi Police's Special Cell, CMM Pankaj Sharma was of the view that the investigation into the matter was not carried in terms of an earlier order dated 25th January 2012 wherein the Police was directed to investigate on specific nine points. In view of this, the Court directed the Police to further investigate the matter wherein the Investigating Officer was directed to file a report on 28th January this year. About the CD ControversyThe CD contains a conversation wherein Shanti Bhushan allegedly tells SP leader Mulayam Singh Yadav that his lawyer-son Prashant Bhushan could fix a judge for a fee and also elucidates a lot on the corruption prevalent in the judiciary. After the CD came into circulation, Shanti Bhushan had filed a complaint with the Delhi Police by alleging that the CD was doctored and fake. The Delhi Police had earlier filed a 'closure report' after claiming that the CD was original. This was however rejected by the Tis Hazari Court in 2011 and the Investigating officer had been asked to reinvestigate the matter. Two reports were then submitted by the CFSL wherein one confirmed the originality of the CD while the other claimed fabrication.
