Allahabad HC Directs SP To Procure Educational Documents Of Girl Selected As SI In UP Police From Father Who Opposed Her Love Marriage

The Allahabad High Court on Wednesday ordered protection for a married couple who had a love marriage against the wishes of the family of the girl.In view of the fact that the Girl has been selected for the post of Sub Inspector in the U.P. Police, however, her father was not providing her the original education documents, the Court directed the S.P., Moradabad to procure all documents from the custody of the father and hand the same over to the Girl.This order was issued by the Bench of Justice Rahul Chaturvedi who was dealing with a plea moved by the Girl. The bench noted that the girl is a major and she has every right to decide her future and exercising her valuable right, she has made a conscious decision to marry as per her own choice. On Court's inquiry, she reiterated that she wants to go with her husband with whom she married, and thus, respecting the Will and desire of the girl, the Court said that she was at liberty to join the company of her husband.Further, the Girl informed the Court that she has been selected for the post of Sub Inspector in the U.P. Police and tomorrow i.e. 28.4.2022 is the date fixed for her documents verification, however, all her original documents are kept with her father who is deeply annoyed with her decision and he is not providing those original documents to her as an arm twisting. In view of this, at the outset, the Court asked the concerned official/senior-most official of the U.P. Police Recruitment and Promotion Board to accommodate the girl for a month to provide her original documents. Further, noting that since there is a total noncorporation from her family member, under the circumstances, the S.P., Moradabad was directed to procure all educational documents and certificates and he was also asked to call upon her father or her family members and direct them to hand over those educational and other relevant documents to her within the time allocated. "There shall be no laxity or tricks would be permitted to father, but to hand over the documents to her. The S.P. Moradabad is requested to personally look into the matter and use his good offices for this purpose...The S.P. Moradabad is also directed to take suitable measures by providing requisite security to the couple so that their life and liberty shall remain secure and may lead to peaceful marital life," the Court ordered as it disposed of the plea.Case title - Smt Lavi Choudhari v.
