Allahabad HC Orders Immediate Medical & Financial Assistance For A Mentally Retarded Lady Found Unattended

Dealing with a Public Interest Litigation (PIL) plea, the Allahabad High Court today ordered Medical and Financial assistance for a mentally retarded lady found roaming on the toads of Lucknow, unattended.The Bench of Justice Devendra Kumar Upadhyaya and Justice Mohd. Faiz Alam Khan was hearing a PIL plea moved by one Jyoti Rajpoot with a prayer to issue appropriate directions ensuring the welfare of a mentally retarded young woman who was found roaming around in an area of Lucknow and was unattended. The PIL plea also made a prayer that appropriate directions may be issued to the State Government to take appropriate action promptly in case any such woman is found unattended roaming on the streets or in public places.Responding to the plea, the State Counsel informed the Court that the said lady had been lodged at "Apna Ghar" Moti Nagar, Lucknow, which is a Women Protection Home.In these circumstances, the Court directed the District Probation Officer, Lucknow to ensure that the lady who is presently lodged in the protection home is attended by a qualified psychiatrist to be deputed by the Chief Medical Officer, Lucknow forthwith. The Court further directed that once the lady is attended by the psychiatrist, it shall be the personal responsibility of the District Probation Officer and Chief Medical Officer, Lucknow to get the requisite medicines administered to the lady. Further, the Court also asked District Probation Officer to personally pay a visit to the lady and enquire about her well-being at the Women Protective Home and the Director, Women and Child Welfare, U.P., Lucknow was directed to extend all possible help including financial help which will be needed for appropriate medical care of the lady.With this, the Court listed the matter for further hearing on February 24, 2022, as fresh, on which date, an affidavit has been called for from the District Probation Officer, Lucknow personally giving details of the steps which might be taken to ensure compliance of the order.Case title - Jyoti Rajpoot v.
