Allahabad HC Seeks UP Bar Council's Assistance In Suo Moto Case Regarding Paucity Of Presiding Officers In UP Revenue Courts

The Allahabad High Court has requested the Bar Council of Uttar Pradesh to assist the court in the suo moto matter regarding the non-availability or paucity of Presiding Officers in the Revenue courts.The Bench of Justice Devendra Kumar Upadhyaya and Justice Subhash Vidyarthi has requested the members of the Bar Council of U.P. who are residents of Lucknow to assist the Court in the matter on the next date [April 27, 2022]. The Court ordered thus as it was informed to the Court that the members of the Bar Council of U.P. who are residents of Lucknow are Advocates Akhilesh Awasthi, Jai Narayan Pandey, Prashant Singh Atal, Pradeep Singh, Janki Sharan Pandey, Paresh Mishra, and Abdul Razzaq Khan. The Court directed the office to convey Court's request to the aforesaid members of the Bar Council of U.P. and asked them to be present on the next date [April 27, 2022] in the matter for the assistance of the Court. The Court also noted that due to the paucity of the Presiding Officers in the Revenue courts, there happens a delay in the disposal of the Revenue cases which include simple matters relating to mutation, correction of revenue records, and demarcation as well. "It is needless to observe that any dispute relating to mutation, correction of Revenue records and demarcation, etc. if left unattended for long some time, sometimes leads to very chaotic situation in the village life which ultimately sometime takes the shape of criminal events even involving murder," the Court remarked.It may be noted that in a previous order of the Court (dated Feb 28, 2020, passed in petition No.30949(MS) of 2019 filed under Article 227 of the Constitution of India), several matters were ordered to be connected with this Suo Motu Public Interest Litigation for the reason that in the said matter as well the primary complaint/grievance of the petitioners was a delay in disposal of the Revenue cases by the Revenue courts, which had been occurring for various reasons including the reason of nonavailability of the Presiding Officers in the court and also the situation caused on account of indiscriminate strike calls being given by the Bar Associations.The HC is currently monitoring the entire situation and making attempts to come up with a solution and in this regard, the assistance of the State Bar Council has been sought.In November 2020, the High Court had asked the State Chief Secretary to file an affidavit indicating the steps taken by the UP Government to provide the necessary infrastructure to Revenue Courts in the state.In January 2021, the Court had registered a suo moto case titled "Suo Moto With Regard To Filling Up All Vacancies In Revenue" to check the lack of Judicial Officers in these Courts.
