Allahabad HC Directs UP Govt To Take Decision On Representations To Include Rajbhar Community In ST List In 2 Months

The Bench of Justice Siddhartha Varma and Justice Dinesh Pathak issued this direction on a plea moved by C/M Jago Rajbhar Jago Samiti moved through Advocate Agnihotri Kumar Tripathi.

Essentially, it was submitted before the Court that the petitioner had applied through a sitting MLA for including the Rajbhar community in the list of Scheduled Tribes.

When the matter reached the Central Government, it wrote to the Principal Secretary, Social Welfare Department, Government of Uttar Pradesh on October 11, 2021, stating that it could not process the matter unless the proposal for including Bhar/Rajbhar community in the list of Scheduled Tribes had been processed by the State Government.

Further, the Court noted that the petitioners have not approached the appropriate authority of the State Government over this matter as yet, however, the Central Government had sent the representations received by various authorities in this regard to the Principal Secretary, Social Welfare Department, UP Govt for the purpose of taking appropriate actions in the matter.

Under these circumstances, the Court stressed that no useful purpose would be served by keeping the writ petition pending before this Court.

Accordingly, the Principal Secretary, Social Welfare Department, UP Govt was directed to take a decision on the representations, which have been forwarded to him by the Central Government within a period of two months in accordance with law.

With this observation, the writ petition stood disposed of.
