    The Allahabad High Court has granted bail to one Nadeem Ansari who has been accused of posting a video on Facebook showing to behead former BJP spokesperson Nupur Sharma.

    The bench of Justice Deepak Verma granted him bail considering the entire facts and circumstances of the case, submissions of counsel for the parties, and keeping in view the nature of offence, evidence, the complicity of the accused and larger mandate on Article 21 of the Constitution of India.

    Essentially, Ansari has been booked under Sections 153.A, 295.A, 505 (2) I.P.C. and Section 67 of Information Technology Act, 2008 on the allegation that he tried to incite communal tension while posting a video on Facebook and mobile showing to behead former BJP spokesperson Nupur Sharma and was arrested on June 13, 2022.

    Before the court, he moved the instant regular bail plea submitting that he is innocent and has been falsely implicated in the case and that there is no evidence of the alleged crime.

    It was next argued that the offence is triable by the Magistrate and that in case he is enlarged on bail he will not misuse the liberty of bail and co-operate in the trial.  In view of this, the Court granted him bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.

    In related news, the Rajasthan High Court recently denied bail to an Ajmer Sharif Dargah cleric who allegedly provoked people and raised Sar Tan Se Juda slogan in a protest rally related to alleged statements made by former BJP spokesperson Nupur Sharma.

    The bench of Justice Sameer Jain denied bail to Syed Gohar Husain Chisti as it noted that if he is released on bail, he might pose a threat to society at large and affect the law and order situation in the State.
