    The Allahabad High Court on Thursday granted interim bail to a couple, accused of misappropriating funds from a Trust maintained by Arunima Sinha, world's first female amputee to scale Mount Everest.

    Sinha had lodged a FIR at Sarojini Nagar Police Station in Lucknow against her sister and brother-in-law, alleging that the two duped her of Rs. 41,50,000/- (in total) using forged documents and signature, and on requesting the applicant/accused to return her money, she was threatened with dire consequences.

    The couple was thereafter booked under Sections 120B (Criminal conspiracy), 406, 409 (Criminal breach of trust), 420 (Cheating), 467, 468, 471 (Forgery) and 506 (Criminal intimidation) of IPC and has been lodged in Jail since May 15, 2020.

    In their bail plea, the couple denied the allegations and submitted that the FIR filed against them is vague and the allegation of misappropriation is sans any evidentiary proof of transaction. 

    A Single Bench of Justice DK Singh has granted 1.5 months interim bail to the accused, to enable the parties to settle the matter amicably.

    "Learned counsel for the accused-applicant submits that the accused-applicants may be enlarged on interim bail for a period of one and a half month and during this time they will strive to get the matter amicably settled through the process of mediation before this Court.

    Considering the aforesaid request of the counsels representing the parties, the accused-applicants are admitted on interim bail for a period of one and a half month from the date of their respective release on furnishing personal bond and two sureties of like amount to the satisfaction of the trial Court," the Bench observed.

    The Court further directed both the parties to appear before the Mediation Centre of the High Court on February 10, 2021.

    The Mediator concerned has been requested to conclude the proceedings preferably within one month and submit a report thereof.

    The matter will now be listed for consideration on March 13, 2021.

    The applicants were represented by Advocates Pradeep Kumar Rai, Devansh Mishra, Hari Om Shukla, Prakarsh Pandey and Praveen Kumar Shukla.

    State represented by Govt Advocate AK Singh, AS Parihar, Maitreyee Singh.
