Allahabad HC Extends Interim Orders Passed By It & Courts Subordinate To It Till January 5

The Allahabad High Court on Tuesday (01st December) extended the operation of interim orders passed by it and by the Courts/ Tribunals subordinate to it, till Tuesday (05th January). The order has been passed by a Division Bench comprising of Justice Munishwar Nath Bhandari and Justice Saurabh Shyam Shamshery as the Court noted that the "position obtaining today is same as was on 20.10.2020, when the last order was passed." Previously, the High Court had extended all interim orders till Tuesday (01st December). Now, yesterday's order has further extended the operation of interim orders till Tuesday (05th January). The Bench said, "A Suo Moto cognizance pertaining to the interim orders and limitation expiring during the period of lock down due to COVID-19 was taken by this Court. A detailed order in reference to interim orders and even limitation expiring during the period of COVID-19 was passed from time to time." Further, the Bench said, "This Court modified the order on 19.08.2020. It was made mainly in reference to the interim orders and caveat entered under Section 148-A C.P.C which were extended till 01.12.2020. The position obtaining today is same as was on 20.10.2020, when the last order was passed. Taking aforesaid into consideration, the order dated 20.10.2020 is further extended and made operational till 05.01.2021." The Court will now review the situation on Tuesday (05th January). It may be noted that the Telangana High Court on Wednesday (25th November) extended the operation of interim orders passed by this Court, as well as by the District and other Subordinate Courts till Wednesday (11th December 2020). Taking suo-moto cognizance of the prevailing extraordinary circumstances, the Full bench of the Telangana High Court issued the said order dated 25th November to extend interim orders passed by the High Court till 11th December 2020.
