    The Allahabad High Court has taken suo moto cognizance of the plight of a couple, released from imprisonment 5 years after battling a false charge of murder, only to find that their two children who were lodged at a Protection Home are missing.

    A Division Bench comprised of Justices Sanjay Yadav and Jayant Banerji has registered a case titled "In Re A Case Looking For Justice" and has issued notice to the State Government, asking the Additional Government Advocate to file a response and the status report by the next date.

    The Bench has taken cognizance of a letter sent to it by a Mumbai based Advocate, drawing the Court's attention to a report of Times of India on the misery of Narendra Singh and Najma.

    The Agra based couple, arrested in connection to the murder of a five-year old boy in 2015, were victims of a shoddy investigation by the local Police. In its order acquitting the couple, the Court of Additional District and Sessions Judge noted that the then sub-inspector did not even try to find out the real culprit and proceeded to file a charge sheet against the couple.

    The order stated,

    "The evidence tendered by Inspector in charge reflects his negligence and indifference to the investigation through which he, instead of tracing the actual culprit(s), tried to take credit for quickly completing the investigation and filing a charge sheet."

    The order further recorded that the prosecution evidence was shaky and no case was made out against them. 

    As per the ToI, the couple now claims that their two children, a son who was five years old at the time and a daughter aged three at the time, are missing. As per the report, the children were sent to an orphanage/ protection home at the time of their parents' arrest.

    On being released, the couple has been unable to locate their children and has filed a complaint in this regard with the concerned SSP.

    The matter is fixed for hearing on April 26.
