Devise Policy For Vaccination Of Physically Disabled: Allahabad High Court To Govt. In Suo Moto COVID19 Case

Days after the Supreme Court asked the Allahabad High Court to pass realistic orders and stayed its directions for upgrading medical facilities in the state, the Allahabad High Court has expressed satisfaction with the steps taken by Uttar Pradesh Government for enhancing the medical infrastructure in the smaller districts of Bahraich, Shravasti, Bijnor, Barabanki and Jaunpur.Further, the Court has directed the Central Government to come up with a stand with regard to vaccination to physically challenged persons, who find it difficult to approach the vaccination centres, in compliance with its order dated May 11. Last week, the High Court while hearing in its suo moto case on Covid-19 had made strong critical remarks against the Government over "fragile and debilitated" medical infrastructure in the State. It had therefore suggested a series of measures to be undertaken by the Government to ameliorate the situation. The order was however stayed by the Supreme Court citing "Doctrine of impossibility". 'High Court Should Avoid Passing Orders Which Are Difficult To Implement' : Supreme Court Stays Allahabad HC Directions For Improving Health Care System Of Uttar Pradesh Today, on perusal of the report filed by the State in this regard, the Division Bench comprising of Justices Siddhartha Varma and Ajit Kumar observed, "We have perused the report and do appreciate that some work has been done with regard to the improvement of medical infrastructure and hope that similar efforts will be made in respect of other districts as well." It has now directed the State Government to give a report with regard to the improvement of medical infrastructures in five more districts, namely, Bhadohi, Ghazipur, Ballia, Deoria and Shamli, by the next date. The Bench also recorded its satisfaction over capping of fee for diagnostics. The new testing rates are as follows: RT-PCR: Rs. 500/- to 900/- Antigen tests: Rs. 200/-. True Nat: Rs. 1200/-. Further, the Court has directed the Central Government to come up with a stand with regard to vaccination to physically challenged persons, who find it difficult to approach the vaccination centres, in compliance with its order dated May 11.
