Allahabad High Court Seeks UP Govt Response On Widow's Plea Against UP Police Frequent Raids On Her Guest House

The Allahabad High Court on Thursday sought the response of the Uttar Pradesh Government on a plea filed by a widow woman alleging that local police is illegally visiting her guest house for ulterior reasons at nights and threatening the manager and other staff working there without any rhyme and reason.The Bench of Justice Saroj Yadav and Justice Ramesh Sinha was hearing the plea of one Renu Upadhyay seeking a writ of mandamus commanding the Uttar Pradesh Government, DGP Police, CP Lucknow, among others to ensure that the local police officers do not conduct raids and searches in her premises.The plea filed by the widow woman states that the local police are illegally interfering in the affairs of the Guest House and they often indulge in the act of beating and misbehaving with the staffs of the Guest House and that they also raid the rooms of the Guest House where the guests/customers are staying. "They say in clear terms that if the police are not managed they will conduct raids in day and night like this and they would also implicate the petitioner and the staffs in false cases," adds the plea.The plea has also submitted that the local police officials often barge into the rooms and misbehave with the customer of the guest house (which is running legally) and it further claims that the police did not disclose as to what kind of information they had gathered from any source which forced them to conduct raids at the premises for as many as three times and that too in the night without having an adequate number of women police.The plea also avers that the raids seriously disturb and affect the Guest House business of the petitioner and which is a clear violation of Article 19(1)(g) of the Constitution of India which protects the right to practice any profession or to carry on any occupation, trade or business.The plea seeks action again the erring police officials and to restrain them from conducting frequent raids and searches on her premises.Advocates Chandan Srivastava, Akansha Mishra and Yogesh Somvanshi appeared on behalf of the PetitionerCase title - Renu Upadhyay v.
