The Special NIA Court on Saturday granted bail to the first accused in the Ambani terror scare and businessman Mansukh Hiran murder case. Bookie Naresh Gaur is accused of supplying dummy the sim cards used by dismissed cop Sachin Waze and former encounter specialist Pradeep Sharma.

Special Judge AT Wankhede granted bail to Gor on execution of bail bond of ₹50,000 with one or two sureties of the like amount. The order has been stayed for a period of 25 days following an application filed by the NIA.

Gor was arrested in March 13, 2021 and booked under section 120B(conspiracy) and 403( dishonest misappropriation of property). Unlike Waze and six other, Gor is not booked under the anti-terror Unlawful Activities (Prevention) Act.

The prosecution alleged that Waze met Gor's boss and asked for dummy sim cards. On his boss's instructions Gor arranged for the sim cards and handed them over to accused Vinayak Shinde, who in turn gave them to Waze and Sharma.

The sim cards were allegedly used in the murder of businessman Mansukh Hiran, whose body was found in the Thane creek 10 days after the explosives and a threat letter were discovered in an abandoned vehicle near the Ambani residence, on February 25.

Advocate Aniket Nikam for Gor argued that Waze never contacted Gor, neither did they ever met nor were there any calls exchanged between them.

He argued that Gor was not informed about the purpose for procuring the sim card. Therefore, allegations of conspiracy were not applicable against him as the law mandated that every conspirator must be aware of the end object of conspiracy.

"Merely by providing sim cards one cannot be said to be part of any conspiracy. Naresh Gor was not aware of the purpose for which the sim cards would be used. He was also not aware that an explosives laden car would be planted outside Antilia or Mansukh Hiran would be killed. Naresh Gor was not aware of any of this. Chargesheet filed by NIA do not anywhere say that Naresh Gor was aware of the end objective of conspiracy," Nikam argued.

"Naresh Gaur ought to have been made a witness but he is been falsely implicated and shown as an accused," he further submitted.

The National Investigation Agency opposed his application for bail. The agency said that Gor was part of the a larger conspiracy to kill Hiran.

Special Public Prosecutor Sunil Gonsalves relied on a diary maintained Gor with a list of numbers.
