    The Allahabad High Court on Monday denied bail to the maid of Slain Gangster Vikas Dubey, Rekha Agnihotri for allegedly aiding and instigating her husband and other accused persons in the killing of eight policemen in Kanpur's infamous Bikru encounter last year.

    She allegedly instigated Vikas Dubey's men to do the policemen to death and she is stated to have been atop a house adjoining Vikas Dubey's, during the entire course of the brutal assault.

    Stressing that the daredevil manner in which the incident took place leaves much to be said, the Bench of Justice Samit Gopal noted that the involvement of the Agnihotri was there in the instant matter and her participation in the entire incident was confirmed by the eyewitnesses.

    The Court went on to note that the bail application of identically placed co-accused (K, a minor) had been rejected by a co-ordinate Bench of the Court.

    Importantly, regarding the gravity of the incident, the Court made the following remark:

    "...it is evident that the present case is a case in which 8 police personnels lost their lives while they were on their duty to raid the house for arrest of accused persons. 06 police personnels received grievous gunshot injuries in the incident. One private person being the driver of a Police personnel also received injuries. The dare devil manner in which the incident took place leaves much to be said. The incident cannot be committed with just a handful persons. It was a pre-planned incident wherein all the aspects appeared to have been designed and persons were entrusted their jobs which had been performed by them independently and even collectively."

    Case against her

    Allegedly, Agnihotri gave out locations of the policemen, who had concealed themselves to save their lives, and exhorted Vikas Dubey's men to do the policemen to death, while the entire encounter between Vikas Dubey and his aids and Policemen was taking place.

    She filed the instant bail application under Section 439 of Code of Criminal Procedure for offences under Sections 147, 148, 149, 302, 307, 504, 506, 353, 332, 333, 396, 412, 120B, 34 I.P.C., Section 7 Criminal Law Amendment Act and, 3/4 Explosive Substance Act.

    Background of the case
    As per the prosecution's case, the Police officials, in strong numbers, had gone to arrest Vikas Dubey, a dreaded gangster. However, somehow, Vikas got the information that policemen were coming to arrest him and thus, he laid in wait, along with his henchmen, for the Police to arrive.

    Vikas's associates, that included his relatives, had positioned themselves at strategic points, atop the roof of his house and those abutting it and as soon as policemen reached there, they opened indiscriminate fire on them, which led to eight police personnel being shot dead and another six sustaining grievous gunshot injuries.

    It is the prosecution case, that while the menfolk pumped bullets into the police personnel, the wives (including Agnihotri) of all the accused were aiding and instigating their husbands.
