Bomb Threat To UP Chief Minister: Allahabad High Court Grants Bail To Accused Considering His Unconditional Apology

The Allahabad High Court on Tuesday (08th December) granted bail to a 25-year-old youth named Kamran Ameen Khan who allegedly sent a WhatsApp message threatening to kill UP chief minister Yogi Adityanath with a bomb. The Bench of Justice Dinesh Kumar Singh was hearing the bail application filed by the applicant (Kamran Ameen Khan) in FIR No.472 of 2020 under Sections 505(1)(b), 505(2), 120B, 506, 507 IPC, 66(F) Information Technology Act. Allegation against Applicant-Accused Allegation against the accused-applicant is that he sent a WhatsApp message on a number associated with Social Media Desk of the Police Headquarter, U.P. from a mobile number. Police had registered an FIR after receiving this WhatsApp message. "Taking note of the seriousness of the threat, the UP Special Task Force started tracing the location of the caller, following which he was located at Chunabhatti in Mumbai," said an official. The message sent by him reads as under: - "cm yogi ko me bomb se marne wala hu musalman k jaan ka dushman h vo" (I am going to kill CM Yogi with a bomb. He is a sworn enemy of the Muslim community). The accused-applicant was arrested on 23rd May 2020 and he has been in jail since 26.05.2020. The accused-applicant tendered an unconditional apology in the Court which was taken on record. In his apology, he stated, "That the accused/applicant hereby tenders his unconditional and unqualified apology for his wrongful act and is sincerely regretting the same. That the accused/applicant hereby undertakes not to commit any such act in future. That it may also be submitted that on account of unprecedented circumstances owing to the spread of coronavirus disease and a nationwide lockdown and the sheer frustration arising from a financial crunch and unemployment being faced by him, the accused/applicant was not in a fit state of mind and was unable to realised the nature and repercussion of his act. That under these circumstances, the action of the accused/applicant deserves to be condoned and his case deserves to be considered sympathetically." Considering the facts and circumstances of the case, unconditional and unqualified apology tendered by the accused-applicant for his act, the Court found it to be a fit case for granting bail. The applicant Kamran Ameen Khan has been directed to be released on bail on his furnishing a personal bond and two sureties of the like amount to the satisfaction of the Magistrate/Court concerned.
