Former Chief Minister Uddhav Thackeray-led Shiv Sena has approached the Bombay High Court seeking directions to the Municipal Corporation of Greater Mumbai for permission to hold the party's annual Dussehra rally at the Shivaji Park ground on October 5, 2022.

The plea states that despite 20 days having lapsed since an application was made to the BMC, the civic body is yet to take a decision on the same.
The matter was mentioned before the bench led by Justice RD Dhanuka that granted circulation for tomorrow.
Advocate Joel Carlos for Sena sought urgent listing of the matter stating that there was no reason that the BMC was not granting permission or not taking a decision regarding holding the party's annual Dusshera rally at Shivaji Park.
The plea states that the Shiv Sena has conducted the Dussehra Melawa, every year since 1966, on the festival of Dussehra at Shivaji Park and the Respondents BMC have always permitted the same on an Application made to them.
Infact, the Government's order 20.01.2016 specifically provides that Shivaji park may be used for Duserra Melawa and that the Municipal Commissioner should permit the same on an Application being made to him, the plea adds.
The plea further states that for the Dussehra Melawa, party workers and leaders from across the State as well as the country arrive at Shivaji Park on the Dussehra day without any invitation and without any formal announcement.
The petition has been filed through secretary and MP Anil Parab and seeks for the BMC to decide Shiv Sena's application for permission within 3 days and pending hearing & final disposal, the Sena should be allowed to conduct the rally there.
On July 3, Shiv Sena's rebel section led by CM Eknath Shinde formed the government in Maharashtra with the BJP.
