A Sessions Court in Delhi has granted three weeks of interim bail on medical grounds to two persons who were arrested by Seelampur police for alleged violence during anti-CAA protests.

Judge Brijesh Kumar Garg of the Karkardooma Additional Sessions Court granted three weeks of interim bail to both the accused from Seelampur Police Station to enable them to receive necessary medical treatment. The Court has also directed the  SIT, Crime Branch to file a detailed reply to the bail application in the meantime.

On 24th December, Duty MM Richa Parihar had directed jail authorities to file a report regarding the medical condition of one of the accused (Moinuddin) and to provide him with immediate treatment.

Yesterday, the SI of SIT Crime Branch and Addl. P.P. informed the court that the cases which had arisen in the aftermath of a protest against the implementation of the Citizenship (Amendment) Act, 2019, had been transferred to the SIT Crime Branch of the District. Consequently, more time would be required to file a detailed report on the same.

With regard to the accused Moinuddin, Advocates Zakir Raza, Mehmood Pracha and Mohd. Danish submitted that the jail authorities were unable to provide proper medical care as the thumb on his right hand was amputated, and therefore, the accused should be released on interim bail for the facilitation of the same. The second accused required psychiatric aid as he was suffering from seizure disorder. The Public Prosecutor did not refute the submissions.

Upon conclusion of the arguments, the Court directed that the first accused Moinuddin should be medically examined at RML Hospital immediately upon release and that the second accused should be examined at Institute of Human Behaviour and Applied Science.

The interim release was contingent on furnishing a personal bond of Rs. 20,000/-. The accused were further directed to not misuse the liberty granted by the court, to not leave Delhi and to mark their attendance at Seelampuri PS on every Monday at 2pm.
