    Under the prevailing circumstances due to the lockdown, the Competition Commission of India has adjourned all matters listed before it for hearing upto May 3, 2020, stating that fresh dates will be issued for the same.

    For all other compliances due up to May 3, 2020 in respect of pending cases, either before the Commission or the DG, fresh dates will be notified.

    In addition to this, the Commission has also notified the procedure for E-filing and E-stamping.

    A Circular issued to this effect provides that information relating to Sections 3 and 4 of the Competition Act, 2002, i.e. information in respect of Anti-competitive agreements and Abuse of dominant position, may be filed electronically. The same has to be sent through email at atdregistry@cci.gov.in.

    Further, the fee in respect of the above filings has to be paid through Electronic Clearance Service by direct remittance to the CCI and soft copies of proof of payment have to be attached.

    That apart, the Commission has stipulated:

    (a) Combination notices may be filed electronically at comb.registryg@cci.gov.in;

    (b) Dates for filing hard copies shall be notified in due course;

    (c) Parties to combination may avail pre-filing consultation (PFC) through video conference. Request for PFC shall be made at cci-consult@nic.in. Thereafter, the combination registry will email a web link which can be accessed by the parties from anywhere.

    (d) The Commission would endeavour to process the new and pending cases subject to the availability of necessary information and material.
