Comply terms of Compromise of Face Contempt of Court, the Supreme Court told a couple who obtained a divorce by mutual consent from it.

The husband had approached the Apex Court as the Allahabad High Court upheld the District court order refusing his plea for divorce.

During the pendency of appeal, the bench referred the couple to mediation. The parties then agreed to amicably settle the matter and filed a separate application agreeing for dissolution of marriage by mutual consent invoking the powers under Article 142 of Constitution of India.

As per terms of compromise husband agreed to pay Rupees Ten Lakh to wife, three lakhs to daughter. He also agreed to contribute another one lakh at the time of solemnization of the marriage of the daughter. Both of them agreed that all the pending 3 cases between the parties shall be withdrawn or they will agree for quashing the respective cases.

While dissolving the marriage, the bench comprising Justice R. Banumathi and Justice S. Abdul Nazeer said:

"In case of non-compliance of the terms of compromise, the parties would be liable for contempt of this Court in addition to other remedies available under law."
