In view of the lockdown announced by several state governments and the Central Govt due to COVID-19, the National Company Law Tribunal (NCLT) has decided to close all its benches from March 23, till March 31, for judicial work.

All counsels/ parties requiring urgent hearing may send an email to the registry of NCLT Chennai and intimate the same to the opposite party, whereafter the Acting President of the Tribunal sitting singly at Chennai will examine and pass necessary orders on Wednesday and Friday.

An application made in that behalf has to be verified by the respective counsel through affidavit by mentioning their bar enrollment number.

However, the Tribunal has urged the parties not to abuse the above process and email should be sent only in cases of urgency. It has been clarified that with regard to the IBC-2016 matters extension of time, approval of resolution plan and liquidation will not be construed as urgent matters. These matters will be taken up as soon as regular benches start functioning and until such time, applications seeking hearing should not to be filed.

Further, it has been clarified that the parties should not arrive to NCLT Chennai as they will not be required to make oral submissions.

Pertinently, the administrative side of the Tribunals will remain functional and the Skeletal staff may attend the office as per decision of the HOD of respective benches, whenever required. Other staff will work from home and remain available on mobile phone.
