    A Delhi Court recently granted bail to a woman who was languishing in jail for 9 years, on the ground that the Chief Metropolitan Magistrate can only pass orders for 7 years of punishment which she has already exceeded.

    The observation came from Additional Sessions Judge Hemani Malhotra:

    "Admittedly the applicant has spent more than 7 years in jail which is the maximum punishment which can be awarded to her by the learned CMM. Needless to say the period of incarceration has not only led to travesty of justice but also reflects poorly on our judicial system."

    The Court noted that the CMM had failed to frame charges against the accused person even though the charge sheet was filed on 30 July 2014. Court also said that the prosecution has cited 133 witnesses which at this snail's pace will take an entire lifetime.

    The Court also pointed out that the Additional public prosecutor has failed to give any reasoning which appeals to the logic of as to why the relief should not be granted.

    In view of the above, and the long incarceration the court granted her bail on furnishing a bail bond of Rs. 1 lakh.
