Delhi Court Allows Jamia Student Accused In UAPA Case To Write Exams In Tihar Jail

A Delhi Court yesterday allowed a UAPA accused, a 22 years old electrical engineering student at Jamia Millia Islamia University, to write exams in Tihar jail as per the examination schedule fixed by the varsity. Principal District & Sessions Judge Sanjay Garg of Patiala House Courts granted relief to Mohd. Mohsin Ahmed who was arrested by the National Investigation Agency (NIA) last year from city's Batla House area. The NIA arrested Ahmed alleging that an information was received that he was actively engaged in raising funds for ISIS.Yesterday, the court allowed Ahmed's application seeking permission to write the seventh semester examination for the B.Tech. (Electrical Engineering) course at Jamia Millia Islamia University.The counsel appearing for Jamia Milia Islamia University submitted that the varsity will depute officials in jail complex during conduct of the examination as per the examination schedule fixed. Accordingly, the court directed that an authorised invigilator of the varsity, whose credential shall be shared with the Tihar Jail Superintendent, shall visit the jail on the scheduled dates i.e. December 08, December 11, December 13, December 15, December 18 and December 20. “The Superintendent Jail shall ensure that arrangements for facilitating the applicant/accused to appear in the examination be made in such a room or library where there is complete peace and congenial environment,” the court said. The FIR was registered by the NIA in June last year based on the information received by the Union Ministry of Home Affairs MHA that certain entities were operating from various parts of the country for the furtherance of terrorist activities of ISIS. The agency alleged that in order to execute the nefarious plan, an organized campaign was launched over the cyberspace supplemented by on ground terror financing activities. Ahmed is the only accused in the case who has been arrested and chargesheeted in the matter. The chargesheet against him was filed in January for the offences under Section 153 A and 153B of Indian Penal Code, 1860, and Section 18, 18B, 38, 39 and 40 of UAPA, 1967. The NIA has alleged that Ahmed, on the directions of an online entity namely Ummimarah, was involved in raising funds for ISIS in India and was in touch with the said entity.The application was moved by Advocates Tamanna Pankaj, Priya Vats and Ahmed Ibrahim. SPP Shilpa Singh appeared for NIA. Advocate Pritish Sabharwal, Standing Counsel for Jamia Millia Islamia University appeared for the varsity.
