A Delhi court on Tuesday sought an action taken report on a woman journalist's complaint seeking registration of an FIR against ACP Vivek Bhagat over allegations of sexual assault.

Judicial Magistrate First Class Kautuk Bhardwaj of Patiala House Courts directed the Station House Officer (SHO) of Parliament Street Police Station to submit a point-wise report addressing whether the complainant had approached the police, what action was taken on her complaint, and whether any cognizable offence was made out against the accused.

The court also directed the police to clarify whether an FIR had been registered and, if so, the status of the investigation. In case no cognizable offence was found, the police must state whether the complainant was informed accordingly.

The court passed the directions while hearing the complaint filed by the woman journalist, identified as Rosy.

The complainant's counsel informed the court that the alleged incident had been captured in CCTV footage covering the place of occurrence. It was submitted that the incident took place on October 03, and an urgent direction was required for preservation of the footage.

Considering the urgency, the court directed the SHO to ensure that all necessary steps are taken within three days of receiving the order for preservation of CCTV footage pertaining to the place of incident, along with any other digital evidence, including body camera footage.

The court further directed the SHO to file a compliance report regarding preservation of the footage within one week.

The matter has been listed for filing of the report on December 01.

In a related news, the Delhi High Court recently refused to stay the investigation in an FIR lodged by ACP Vivek Bhagat under the SC/ST Act against the woman journalist.

The female journalist had filed a complaint accusing Bhagat of sexual harassment during the protest. However, no FIR has been registered yet on her complaint.

Later, the ACP filed an FIR against the journalist on allegations that she and her colleagues subjected Bhagat to “public humiliation and casteist slurs” while he was discharging his duty during the protest against CEC Gyanesh Kumar.
