The Delhi High Court on Wednesday directed the District and Sessions Judge (Headquarters) to ensure that as long as the e-filing portal of the Delhi District Courts is functional, it accepts electronic filing of Caveats.

The Bench of Justice Rekha Palli was hearing a plea raising grievance that the e-filing portal of the Delhi District Courts is not permitting electronic filing of Caveats.

The Counsel for the respondent/District And Sessions Judge (Hq), Tis Hazari Court submitted that the contention of the petitioner was incorrect and that the e-filing portal of all District Courts was accepting and would continue to accept Caveats through e-filing mode.

However, the counsel for the petitioner drew Court's attention to the screenshot of the objections raised by the Registry to the petitioner's attempt to file the Caveat online namely.

The Court noted that the defect appeared to suggest that the petitioner was indeed asked to file the caveat at the filing counter.

However, in view of the categorical stand taken by the respondent that e-filing of caveats is and would continue to be permitted, the Court said that no further orders were called for in the petition.

    However, the Court directed:

"The Delhi District and Sessions Judge (Headquarters) shall ensure that in the future, no litigant or counsel is caused any inconvenience on this ground and henceforth, as long as the e-filing portal of the Delhi District Courts is functional, it will accept electronic filing of Caveats."

With this, the petition stood disposed of.
