The Delhi High Court has said that it hopes and expects that the State would be more prompt in deciding prisoners' applications for grant of emergency parole.

Justice Subramonium Prasad recently made the observation while dealing with the plea filed by one Ashutosh Tiwari seeking a direction on the State to release him on emergency parole for a period of 90 days.

Tiwari had filed an application for grant of emergency parole in May, 2021, however, the same was decided only in the month of October after he approached the Court.

"This Court hopes and expects that the State would be more prompt in deciding the application of grant of emergency parole," the Court said.

In September, the Court had directed the State to take decision on the petitioner's application as early as possible being not later than two weeks.

During the course of hearing, Advocate Harsh Prabhakar appearing for the petitioner submitted before the Court that the application was decided and rejected vide order dated 06.10.2021.

In view of the same, permission was sought to withdraw the instant petition with liberty to challenge the rejection of parole by filing an appropriate petition before the competent court.

"Liberty, as prayed for, is granted. The petition is dismissed as withdrawn," the Court ordered.

Additional Standing Counsel Richa Kapoor appeared for the State.
