    Justice Yashwant Varma of Delhi High Court has invited lawyers to make submissions on the aspect of court’s power to partially modify or set aside an arbitral award, doctrine of severability and scope of section 34(4) of Arbitration and Conciliation Act, 1996.

    As per the notice published in today’s causelist, the lawyers who wish to make submissions on the legal points can do so in Justice Varma’s court on April 20 in two cases which are listed at the end of the board.

    The case details are:

    - Trichy Thanjavur Expressway Authority v. NHAI OMP (COMM) 106 of 2023

    - NHAI v. Trichy Thanjavur Expressway Authority OMP (COMM) 95 of 2023

    “The court is considering questions relating to the power of a court to partially set aside/modify an arbitral award, the doctrine of severability as well as the scope of section 34(4) of the Arbitration and Conciliation Act, 1996,” the notice reads.

    It adds: “The court invites learned counsels who wish to address submissions in this regard on 20.04.2023…”
