    The Allahabad High Court on Wednesday granted bail to one Manjeet Yadav, who is an accused in the 2013 Deputy Superintendent Of Police Zia-ul Haq Murder Case in view of his long incarceration of 9 years in jail. 

    Essentially, Manjeet Yadav had moved to the High Court with the instant bail plea on the ground that he has been in jail for more than nine years from the date of his arrest, the prosecution has concluded the evidence of its witnesses and now, the defence witnesses are being examined.

    The accused argued before the Court that the coaccused have been granted bail by the High Court; they have identical roles as of the accused-applicant and that the accused-applicant has no criminal history except the present case.

    On the other hand, the CBI opposed the bail plea and submitted that the accused-applicant and co-accused not only interfered in public functions but they mercilessly assaulted the deceased and killed him.

    It was further argued that there is no delay in the conclusion of the trial and it is the accused who are delaying the trial and they have submitted a list of 13 witnesses to be examined as defence so as to delay the trial unnecessarily.

    However, considering his long incarceration in jail and the fact that there is no previous criminal history of the accused-applicant except the present case, the trial is almost complete where defence witnesses are being examined, the bench of Justice Dinesh Kumar Singh ordered to enlarge him on bail.

    About DSP Zia-ul Haq Murder Case

    For the uninitiated, the case dates back to March 2013, when DSP Haq had gone to a village in Uttar Pradesh's Pratagarh District, in respect of a crime. He was allegedly assaulted and mercilessly killed by the accused applicant and co-accused.

    The names of many people including the then cabinet minister Raja Bhaiya (now an MLA), and his close aid Gulshan Yadav, had surfaced during the investigation of this case. Later on, the CBI took over the investigation of the case and it accused the son of village head Nanhe Yadav, who was killed hours before Haq, Yogender Yadav alias Bablu besides Nanhe's brothers Phulchand Yadav and Pawan Yadav for the murder.

    Eight of the Nanhe's associates Raghuvender Yadav, Manjeet Yadav (the applicant herein), Ghanshyam Yadav, Ram Lakhan Gautam, Chhote Lal Yadav, Ram Ashre, Munna Lal Patel, Shiv Ram Passi and Jagat Bahadur Pal alias Bulle Pal were also booked under Sections 302, 147, 148, 323, 332, 353, 506 201 read with 149 IPC

    In June 2013, CBI filed a charge sheet against 13 people, however, it did not name former minister Raghuraj Pratap Singh alias Raja Bhaiya as accused in the case.
