    In a big relief for the PSU's (Gail Gas Limited and its subsidiaries), the Delhi High Court granted stay of the Public Notices along with the consequent Hearing Notices issued by Petroleum and Natural Gas Regulatory Board ("PNGRB") to them. These notices were issued by PNGRB for inviting comments and holding a hearing regarding declaration of the following geographical areas...

    In a big relief for the PSU's (Gail Gas Limited and its subsidiaries), the Delhi High Court granted stay of the Public Notices along with the consequent Hearing Notices issued by Petroleum and Natural Gas Regulatory Board ("PNGRB") to them. These notices were issued by PNGRB for inviting comments and holding a hearing regarding declaration of the following geographical areas as common carrier or contract carrier.

    Gail Gas Limited and its subsidiaries challenged the notices issued under the PNGRB (Guiding Principles for Declaring City or Local Natural Gas Distribution Network as Common Carrie or Contract Carrier) Regulations, 2020. The aforesaid notices were ultra vires the PNGRB Act and suffered from procedural ultra vires as they were passed in the absence of Member (Legal) of the Board. In view of these submissions, the Division Bench of the Hon'ble High Court of Delhi comprising of the Hon'ble Chief Justice and Hon'ble Justice Jyoti Singh passed the order staying the operation and implementation of the Public Notices dated 13.09.2021 and Hearing Notices issued by PNGRB to them till next date of hearing.

    Mr. Darpan Wadhwa, Senior Advocate appeared and argued on behalf of the PSU's and were advised and represented by a legal team of Karanjawala & Co. comprising of Ms. Ruby Singh Ahuja, Ms. Hancy Maini, Ms. Akanksha Thapa and Mr. Lakshya Khanna.
