A petition has been filed in the Delhi High Court against Guru Gobind Singh University (GGSIPU) for their decision to conduct physical examination for previous intermediate semester, tentatively from October 27, 2020. The petition seeks postponement of the exam till the time situation normalizes in light of the recent BCI clarification dated 08/10/2020. The petition has been filed by a group of students from University School of Law and Legal Studies( USLLS), Amity Law School Delhi ( ALSD) and Vivekananda Institute of Professional Studies ( VIPS), colleges affiliated to GGSIPU. The petitioners are represented by advocates Shivam Singh and Sahil Raveen.

The students were informed about the University's decision to conduct examination for the first time through a notice dated 30th September, 2020.

It is contended that the aforementioned notice is in total disregard of the previous notices of the University and also of the University Grants Commission and contrary to the essence of the notice of the Bar Council of India dated 9/6/2020.

The University relied on the BCI guidelines which had asked the law universities and colleges to conduct end semester examination for the previous intermediate semester students within a reasonable time from the reopening of the college. According to the petitioners,  on 8th October, 2020, the BCI had clarified that physical examination are to be conducted only when the pandemic gets over and normalcy prevails. Therefore, it is evident that the University's decision to go ahead with the exams on October 27 is against the BCI guidelines, the petitioners argued.

It is stated that several representations were sent by hundreds of the students but they failed to evoke any response.

It is pointed out that other Law Universities that are conducting intermediate examinations are conducting it via an alternate modes such as assignments or online mode. Reputed colleges like National Law University Delhi, Jamia Millia Islamia, Panjab University and O.P. Jindal University have moved towards evaluation on the basis of marks secured in the previous semesters, assignments and online tests while Symbiosis Law School, Noida didn't announce exams.

The petitioners are Shaurya Samarth Singh, Achint Jain.
